Refund Policy
Brand: Markexta
This Refund Policy governs all payment transactions made in connection with Markexta Services. By completing any payment to Markexta, the Client unconditionally acknowledges, accepts, and agrees to this Policy in full. This Policy forms part of the binding agreement between Markexta and the Client alongside the Terms & Conditions and Privacy Policy published at markexta.com.
1. Preamble
Markexta operates exclusively as a provider of digital services. All Markexta Services are produced on a one-time basis and delivered electronically. Given the nature of digital service delivery, where production labour, research, and resources are committed from the moment of payment, all payments made to Markexta are treated as final from the point of receipt.
Markexta reserves the right to amend, modify, or replace this Refund Policy at any time and without prior notice. The revised Policy will take effect immediately upon publication at markexta.com. Continued use of any Markexta Service or engagement with markexta.com following such publication constitutes irrevocable acceptance of the amended Policy.
2. Absolute No-Refund Policy
All payments made to Markexta for any Markexta Service are final, irrevocable, and non-refundable under all circumstances without exception. No refund, partial refund, credit note, service credit, compensation, or substitute of any kind will be issued, considered, or processed at any point after payment has been received by Markexta.
This policy applies universally, unconditionally, and without exception regardless of whether the Markexta Service has been delivered or is pending delivery at the time of any request, whether the Client has accessed, used, downloaded, or opened the delivered service, whether the Client is dissatisfied with the delivered service for any reason including quality, relevance, applicability, or performance, whether the Client's business circumstances, priorities, or direction have changed after payment, whether the Client has misunderstood the nature, scope, format, or content of the Markexta Service purchased, whether a technical issue, platform outage, or hosting unavailability affected access to the service at any point within the Access Period, whether the Access Period has not yet commenced or has already expired at the time of the request, whether the Client failed to download or preserve their deliverable files before expiry of the Access Period, and whether a third-party platform used in production or delivery experienced any disruption, policy change, or failure.
By completing payment, the Client irrevocably and unconditionally waives any right, claim, or entitlement to a refund under any law, regulation, or consumer protection framework to the fullest extent permitted by applicable law.
3. No Exceptions
Markexta does not recognise any exception to this no-refund policy under any circumstances. The following do not constitute valid grounds for a refund claim and will not be considered under any conditions.
Force majeure events affecting Markexta's ability to deliver on a scheduled date do not constitute grounds for a refund. Dissatisfaction with the business outcomes, results, or impact of any Markexta Service does not constitute grounds for a refund. Changes to the Client's business model, strategy, market focus, or priorities after purchase do not constitute grounds for a refund. Failure by the Client to provide required inputs within agreed timeframes does not constitute grounds for a refund. Expiry of the applicable Access Period without the Client having downloaded or preserved the delivered files does not constitute grounds for a refund. The BGI Service ceasing to be accessible after the three-month guarantee window does not constitute grounds for a refund. Any verbal or written representation made by any Markexta representative that is not expressly confirmed in a signed written agreement between the parties does not constitute grounds for a refund.
4. Chargebacks and Payment Disputes
Initiating a chargeback, payment reversal, or dispute through any bank, card network, payment processor, or regulatory body after payment has been received by Markexta does not constitute a valid refund request and shall be treated as a material breach of the Terms & Conditions.
In the event of any chargeback or payment reversal being initiated by or on behalf of the Client, Markexta reserves the right to immediately and without notice suspend or permanently revoke all access to any and all Markexta Services including hosted dashboard links and downloadable file access. Markexta further reserves the right to pursue recovery of the full Service Fee through all available legal means including civil proceedings and debt recovery under Indian law and any applicable foreign jurisdiction. The Client shall be held liable for all costs incurred by Markexta in recovering such amounts, including legal fees, arbitration costs, and collection charges.
5. No Revisions Within Any Access Period
No Markexta Service includes any provision for revisions, corrections, amendments, iterations, or recreations of delivered content at any point. During the Access Period, Markexta's sole obligation is to maintain hosted access and downloadable access to the service as originally delivered. Any request for changes, modifications, additions, or corrections to any delivered Markexta Service will not be acknowledged, processed, or responded to under any circumstances. If a Client requires a revised, corrected, or new version of any service, the Client must purchase a new Markexta Service at the prevailing price at that time.
6. Access Period Expiry
The expiry of any Access Period does not create any right to a refund, compensation, replacement, extension, or redelivery of any kind. Markexta bears no responsibility for any loss suffered by a Client as a result of failing to download or preserve delivered files before the Access Period expires. The Access Period for all Markexta Services is one (1) year from the Delivery Date. The Access Period for the BGI Service is three (3) months from the Delivery Date. These periods are known, published, and accepted by the Client at the time of purchase. Their expiry constitutes no grounds whatsoever for any claim against Markexta.
7. BGI Service
Where the BGI Service is provided at no charge, no payment transaction is involved and this Refund Policy is inapplicable. Where any fee is charged in connection with the BGI Service, the same absolute no-refund policy set out in Section 2 applies in full without exception. The expiry of the three-month BGI guarantee window, whether or not the Client accessed or used the BGI Service during that period, does not constitute grounds for a refund of any amount paid.
8. New Purchases
Where a Client wishes to receive a revised, updated, or new version of any Markexta Service following the expiry of an Access Period or at any other time, the Client must initiate a new purchase at the price prevailing at that time. No previously paid amount will be credited, applied, or deducted from the price of any new purchase. Each purchase is treated as an independent and complete transaction.
9. Governing Law and Dispute Resolution
This Refund Policy is governed exclusively by the laws of the Republic of India. Any dispute arising under or in connection with this Policy shall be resolved exclusively through binding arbitration under the Arbitration and Conciliation Act, 1996, seated in India. The language of arbitration shall be English. The arbitrator's award shall be final and binding on all parties.
10. Contact
All payment-related enquiries must be directed to contact@markexta.com. Markexta does not accept verbal, postal, or in-person refund requests. Submission of a refund request by any means does not constitute an acknowledgement by Markexta of any entitlement to a refund and will not alter the application of this Policy under any circumstances.
